1. About LOXIM
LOXIM is a companion app for flight simulator enthusiasts. It allows users to discover real airline routes, plan and log simulated flights, track statistics, export flight plans to third-party tools such as SimBrief, and share flight cards on social media.
LOXIM is not affiliated with any airline, aircraft manufacturer, or flight simulation software provider. LOXIM is intended solely for entertainment and flight simulation purposes.
2. Eligibility
You must be at least 13 years old to create an account and use LOXIM. If you are between 13 and 18 years old, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly collect personal information from children under 13. If we learn that a user is under 13, we will promptly delete their account and associated data.
3. Accounts
3.1 Browsing Without an Account
You may browse certain features of LOXIM, including the home screen and route discovery, without creating an account.
3.2 Account Creation
To save flights to My Logs or My Roster, you must sign in using a supported social login provider (Google or Apple). Authentication is managed by Clerk, a third-party authentication service. By signing in, you authorize us to receive basic profile information (name and email address) from your chosen provider. We do not receive or store your password.
3.3 Account Responsibilities
You are responsible for all activity that occurs under your account. You must not allow others to access your account. If you suspect unauthorized access, please contact us immediately at support@loxim.app.
3.4 Account Deletion
You may delete your account at any time through the App's settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
4. Subscriptions and Payments
4.1 Free and Paid Plans
LOXIM offers a free plan with access to a limited set of features and a paid subscription plan with access to additional features. The scope of each plan is described within the App prior to purchase.
4.2 Billing and Renewal
Paid subscriptions are billed through the Apple App Store or Google Play Store. Subscriptions renew automatically unless you cancel before the renewal date. We do not process or store payment information.
4.3 Right of Withdrawal (Widerrufsrecht)
If you are a consumer in the European Union or the United Kingdom, you have the right to withdraw from a subscription purchase within 14 days of the transaction date without giving any reason. To exercise this right, contact Apple or Google through their respective support channels.
4.4 Changes to Pricing
We may change subscription pricing from time to time. Any price increase will not apply to your current billing period. You will be notified of price changes at least 30 days in advance.
5. User Content
5.1 Your Data
Any flight logs, roster entries, statistics, and preferences you create within LOXIM ("User Content") belong to you. By using the App, you grant us a limited, non-exclusive, revocable licence to store and process your User Content solely for the purpose of providing and improving the LOXIM service.
5.2 Shareable Cards
When you generate and share a flight card, the image is created locally on your device. You are responsible for the content you share and for complying with the terms of the platform you share it on.
5.3 Data Export
You have the right to export your User Content at any time. Details are available within the App or by contacting support@loxim.app.
6. Acceptable Use
You agree not to:
- Use LOXIM for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to reverse-engineer, decompile, disassemble, or extract the source code of the App, except to the extent expressly permitted by applicable law.
- Use automated tools, scripts, bots, or scraping mechanisms to access the App or extract its data.
- Interfere with or disrupt the App's infrastructure, servers, or networks.
- Misrepresent your identity or impersonate any person or entity.
- Upload or transmit any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
7. Termination
7.1 Termination by You
You may stop using LOXIM and delete your account at any time through the App's settings or by contacting support@loxim.app.
7.2 Termination by Us
We may suspend or terminate your access to LOXIM if you materially breach these Terms, engage in harmful conduct, your account shows no activity for 24 or more consecutive months, or we are required to do so by law.
7.3 Effect of Termination
Upon termination, your right to use the App ceases. Sections 5.1, 8, 9, 10, and 13 will continue to apply.
8. Third-Party Services
LOXIM integrates with third-party services including SimBrief (flight plan export), Clerk (authentication), Google and Apple (social login), and analytics/crash reporting providers. Your use of third-party services is subject to their own terms and privacy policies.
9. Intellectual Property
9.1 Our Content
All content, design, branding, code, and curated data within LOXIM (excluding User Content) is owned by Johan Nzokam or used under licence. You may not copy, modify, distribute, or create derivative works without prior written consent.
9.2 Third-Party Trademarks
Airline names, aircraft designations, airport codes, and related trademarks referenced in the App are the property of their respective owners. LOXIM is not endorsed by, sponsored by, or affiliated with any airline, aircraft manufacturer, or aviation authority.
10. Disclaimers
10.1 No Real-World Aviation Use
LOXIM is designed exclusively for flight simulation entertainment. Route data and aircraft information must not be used for real-world flight planning, navigation, or operational decisions.
10.2 No Warranty
To the extent permitted by applicable law, LOXIM is provided "as is" and "as available" without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
10.3 Data Accuracy
While we strive for accuracy, airline routes, airport data, aircraft information, and departure times may be incomplete, outdated, or contain errors.
11. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the total amount you have paid to us in the 12 months preceding the event giving rise to the claim, or EUR 50, whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, intentional misconduct, gross negligence, or any other liability that cannot be excluded under applicable law.
12. Consumer Dispute Resolution
In accordance with Article 14(1) of EU Regulation No 524/2013, the European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board at this time.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. For consumers, the courts of your place of habitual residence shall have jurisdiction. For all other users, the exclusive place of jurisdiction is Heidelberg, Germany.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of LOXIM.
